Workers Compensation Victoria (VIC)
What is Workers Compensation?
If you sustain an injury whilst either on your way to work or whilst at work, you may be entitled to compensation under the Victorian Accident Compensation Act 1985 which aims to assist the worker return to work with as much injury and financial support as possible.
In Victoria, it is compulsory for an employer to hold workers compensation insurance. Regardless of whether it is your fault or not, you may still be able to claim for compensation for the injuries sustained.
If you were injured on or after 20 October 1999, you may be entitled to sue for common law damages for the injuries sustained. You must be able to prove negligence and your work injury must be determined "serious" as under the Accident Compensation Act 1985.
When Can I Claim?
There are time limits in place - you must advise your employer within thirty (30) days of sustaining the injury, failure to do this could mean you lose your entitlement to compensation. Time extensions may be available - If you have sustained an injury at work, you should contact Legal Injury today to discuss your options further.
