What is Workers Compensation?

If you are injured at work in Tasmania, either on your journey to or from work or whilst at work, you may be entitled to compensation under the Workers Compensation and Rehabilitation Act 1988.

Whether you are at fault or not is irrelevant, as the Workers Compensation scheme is set up assist workers on a 'no fault' basis.


When Can I Claim?

You are able to make a claim when you have sustained an injury at work and you are considered to be a worker.

In order to be determined a worker you must work under a contract of service or a contract of training with the employer.

You may be able to claim if you sustain a personal injury whilst at work, or contract a work related disease whilst at work, on your way to or from work or work related training.


How Do I Claim?

You must lodge a claim as soon as is reasonably possible after sustaining the work related injury.

You must advise your employer as soon as possible of the injury. In the event you voluntarily leave your employment in which you sustained the injury, you must advise the employer within six (6) months of leaving the employment.

In the event of physical injury, an injury compensation claim must be made to the relevant workers compensation insurer within six (6) months of the date of the injury. In the event of a fatal injury, a claim must be lodged by the dependents within six (6) months of the death.
