What is Workers Compensation?
If you sustain an injury whilst either on your way to work or whilst at work, you may be entitled to compensation under the ACT Workers Compensation Act 1951 which aims to assist the worker return to work with as much injury and financial support as possible.
In the Australian Capital Territory, it is compulsory for an employer to hold workers compensation insurance. Regardless of whether it is your fault or not, you may still be able to claim for compensation for the injuries sustained.
There is also cover for people who are traveling to or from work and also in connection with their employment.
When Can I Claim?Time limits can apply, if you are injured you must report the injury as soon as possible to your employer and lodge the incident formally as an incident report.
You must provide medical evidence from your doctor supporting your claim and a claim needs to be lodged with your employers' insurer.
Your claim must be lodged within three (3) years of the date of the incident. Time extensions may apply in some circumstances.
In order to make a claim for compensation, you must be considered a worker - which means that you are employed under a 'contract of service' or a 'contract for service'. There must be an employee - worker relationship.
