Your rights as a victim

If you are the victim of a crime in Victoria, you may be eligible to apply for compensation under the Victims of Crime Assistance Act 1996.

As a victim of an act of violence, you have the right to apply for compensation for the injuries sustained.

It is essential that you advise the Police as soon as possible after the incident occurs in order that you are eligible for compensation for the injuries sustained.

What may I be entitled to?

If you are the victim of an act of violence that resulted in physical or psychological injury or pregnancy and the Police believe a crime had been committed, you may be entitled to compensation.

Under the Victims of Crime Assistance Act 1996, you may be entitled to compensation if you were:

  • the person who directly sustained injury or fatality as a result of an act of violence
  • present at the scene of the offence and were injured whilst witnessing the act of violence
  • a close family member, dependent or involved in an intimate relationship with a victim who was fatally injured
You may be entitled to:
  • medical expenses
  • some loss of earnings
  • reasonable funeral expenses
  • other reasonable and approved expenses

  • Time Limits

    You must lodge a claim within two (2) years of the date of the offence.
